Contrary to the false impression created by the recent City of Lafayette public
announcement headline, the decision of the Terraces lawsuit is not finalized.
Save Lafayette appealed the Superior Court decision in Martinez to the
Appellate Court in San Francisco. The Superior Court paid very little
attention to the very high fire hazard risk of the site and the lack of an effective
evacuation plan for the residents of The Terraces and surrounding community. Nor is
there an effective wildfire evacuation plan for the students of Acalanes High School and
Springhill Elementary. The bus evacuation plan offered by the City and developer – key
to approval of the project – was completely rejected by County Connection. Additional
issues to be revisited by the Appellate Court are inconsistency with the General Plan and Zoning, and other unavoidable environmental impacts.
Our attorneys continue to believe Save Lafayette has a very strong case. Just as with
the last three cases that Lafayette residents brought against the City of Lafayette and
took to appeal, Save Lafayette is confident of a positive outcome at the Appellate Court.
